Terms of Use

These terms are an agreement between you and Daynapse LLC ("we", "us") for using the Daynapse app and website. By using Daynapse you agree to them. If you don't agree, please don't use the app.

Not medical advice

Daynapse helps you log and understand your days. Targets, Patterns, plans and anything the assistant says are general information, not medical, nutritional or fitness advice, and they are not a diagnosis or treatment. Talk to a doctor or other qualified professional before changing your diet, exercise or medication, especially if you are pregnant, have a health condition or are under 18. Don't ignore professional advice because of something you saw in Daynapse. In an emergency, call your local emergency number.

Your account

You need to be at least 13 to use Daynapse, and if you are under 18 you need a parent or guardian's permission. You sign in with your email address; keep access to it secure, since anyone who can read your email can sign in. You are responsible for what happens in your account.

Your content

What you log, write and upload is yours. You give us permission to store, process and send it to our service providers only as needed to run Daynapse for you, as described in our Privacy Policy. You can export or delete it at any time in the app.

The AI assistant

The assistant uses AI, which can be wrong: it may estimate foods incorrectly, misread a photo or give an answer that doesn't fit you. Check what it logs and suggests. Every change it makes can be undone. AI is optional and you can turn it off in Settings.

Free and Pro

Daynapse is free to start, with daily limits on AI messages and photos and access to recent days. Daynapse Pro is an auto renewing subscription with higher limits and all your days. The price is shown in the app before you buy. Payment is charged to your Apple account, and the subscription renews unless you cancel at least 24 hours before the end of the current period. You can manage or cancel it in your Apple account settings. Refunds are handled by Apple under its policies. We may change features, limits or prices; a price change for an existing subscription follows Apple's rules and you will be told before it applies.

Acceptable use

Don't misuse Daynapse: don't try to break into or overload our systems, get around the limits, reverse engineer the service, use it to break the law, or upload content you don't have the right to share.

Ending your use

You can stop using Daynapse and delete your account at any time from Settings. We may suspend or close an account that breaks these terms or puts the service or other people at risk. We may also change or stop the service; if we stop it entirely we will give you reasonable notice and a way to export your days.

Disclaimers

Daynapse is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including that the service will be uninterrupted, error free or that its information is accurate or fit for a particular purpose.

Limitation of liability

To the extent the law allows, Daynapse LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or health outcomes, arising from your use of Daynapse. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 if that is more. Some places don't allow these limits, so they may not apply to you.

Apple

These terms are between you and Daynapse LLC, not Apple. Apple is not responsible for the app, its content, maintenance, support or any claims about it. If the app fails to meet a warranty that applies, you may tell Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third party beneficiaries of these terms and may enforce them against you. You must also follow the App Store's terms when you use the app.

Changes to these terms

We may update these terms. We will change the date above and tell you in the app or by email before a significant change takes effect. Using Daynapse after that means you accept the new terms.

Law

These terms are governed by the laws of the United States and of the state where Daynapse LLC is organized, without regard to conflict of law rules. Nothing here takes away rights you have under the consumer laws of where you live.
